The Intellectual Property Liaison is primarily responsible for coordination, investigation, decision support and implementation for ASD IP matters, as well as advising and assisting engineers/inventors with respect to invention disclosures and relevant third party IP and coordinating the activities of in-house and outside IP legal counsel.
ESSENTIAL DUTIES AND RESPONSIBILITIES include the following. Other duties may be assigned.
Invention Disclosures, Patent Preparation and Prosecution
Review Projects to identify potentially patentable inventions. Educate and advise engineers/inventors on requirements for patentability. Assist engineers/inventorsin the preparation of invention disclosures. Assist the IP Review Team in reviewing disclosures and making filing decisions thereon. Coordinate the preparation of patent applications for selected invention disclosures with the Smith & Nephew Legal department and outside counsel, as needed. Assist in the analysis of office actions from the Patent Office with inventors and attorneys to prepare a response.
Searching and Patent Mapping
Train and assist product development personnel in formulating and conducting prior art searches for purposes of general background research, product clearance, invention patentability and infringement assessments. Work with IP legal counsel to prepare legal opinions. Prepares and maintains as needed patent landscapes and assessments which may include patent maps and/or citation trees.
Infringement Investigation and Litigation Support
Assist legal counsel in locating and reviewing S&N and competitive product, technical and business documents relevant to patent infringement and patent enforcement matters.
Intellectual Property Review Team Meetings
Attend IP Review Team meetings to assist in the presentation of invention disclosures and the business cases for filing of patent applications. Review the progress in the prosecution of filed applications and assess the prosecution strategy. Participate in discussions regarding appropriate foreign filing of counterpart applications.
Other Job Functions
As appropriate, coordinate non-US IP activities with the Patent and Trademark Group of York and other Smith & Nephew, Inc. global business units.
Support outside IP counsel as needed.
Educate ASD staff regarding IP policies and procedures.
Other duties may be assigned as needed.
Required Skills
Required Experience
Bachelors degree in engineering or a related field plus a minimum of 3 years experience related to intellectual property responsibilities with some time devoted to patent prosecution, searching and litigation support.
Excellent writing and communication skills and the ability to assess needed activities and initiate action with newly met individuals.
Knowledge of various software applications which include the MS Office Suite and patent search utilities.
