The Company is seeking an Attorney to fill a new position in the Legal Department of Associate Corporate Counsel at our Brentwood, Tennessee headquarters. JOB SUMMARY:
The Attorney will actively participate as a key member of the Legal Department in supporting all facets of the business of the Company as directed by the Chief Legal Officer, but with a primary focus and responsibility for working with the Companyâs in-house litigation paralegal, outside litigation counsel, the Companyâs insurance broker and underwriters, and the! Medical Director of Risk Management to manage the Companyâs! risk management program, including all claims and litigation. The position reports to the Companyâs Chief Legal Officer.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
Works closely with the Companyâs outside counsel and underwriter claims adjusters in managing and facilitating the Companyâs obligations in connection with all claims, litigation and other matters involving the Company, any of its facilities or health care providers.
Works with the Companyâs Medical Director of Risk Management to assess and advise the Company as to strategy and responses to claims or incidents.
Work with the Companyâs physician population to provide assistance on matters such as responding to legal and regulatory process.
Oversee and maintain the Companyâs portfolio of insurance policies in cooperation with the Companyâs insurance brokers.
Oversee the Companyâs overall Risk Management program.
As directed, assist in the! negotiation and drafting of physician employment agreements and hospital client agreements across the variety of Company service offerings.
Supports the Company in creating, refining and managing fundamental business controls and processes, including contract policies, protocols and standardized forms.
Provides preventive legal counseling and training
EDUCATION AND/OR EXPERIENCE REQUIRED:
JD from an accredited law school with strong academic scores and licensure, or ability to obtain licensure, in Tennessee.
3 to 5 years of experience with actual medical malpractice defense litigation in a law firm environment.
Demonstrated ability to communicate effectively with all levels of management, Company executives, physicians, insurance companies, attorneys, regulatory agencies, suppliers, customers and others.
Demonstrated ability to work independently; self-disciplined and highly organized
Demonstrated ab! ility to operate effectively in a fast-paced environment, managing mult! iple projects with competing priorities.
Excellent analytical skills, including the ability to accurately apply complicated regulatory schemes to specific facts in order to assess compliance.
Ability to provide practical, creative business solutions to difficult legal problems.
Primarily interested in candidates with strong knowledge of and work experience with hospitals, physicians, physician practices or other health care providers.
Basic working knowledge and understanding of, and ability to provide legal advice with respect to, health care laws and regulations (including the Anti-Kickback Statute; the Stark Law; state fraud and abuse laws; and Medicare/Medicaid rules and regulations), privacy laws, CMP issues.
Negotiation strategy and contract drafting skills.
