The Bureau of TennCare, Tennessee Department of Finance and Administration has an opening for a Deputy General Counsel. This attorney will ! supervise the newly-created Eligibility Hearing Officer Unit within the Office of the General Counsel (OGC) which will include approximately 15 attorneys who will sit as administrative hearing officers for eligibility appeals and their supervisors.

Position
The Bureau of TennCare operates the Tennessee Medicaid program which provides health care to nearly 1.3 million Tennesseans. Effective January 1, 2014, TennCare will reassume responsibility for handling eligibility applications and appeals from the denial of eligibility

This person will be responsible for creating and implementing training and other policy requirements for all personnel members within the Eligibility Hearing Officer Unit. They will mentor, answer questions, and evaluate legal or policy questions at the request of the General Counsel or those being supervised. The duties of this position include evaluating and reviewing the consistency of the Initial Orders being approved by 2 direct! reports who are tasked with ensuring day-to-day consistency o! f application of eligibility rules. In addition, this person will create job plans, conduct interim and final evaluations of direct reports. This person will also assist the General Counsel with work associated with the hiring/termination process of all direct reports, including conducting interviews, reference checks, and administrative tasks associated with new hires/terminations, etc. This person will be required to work with other HCFA divisions as necessary regarding matters pertaining to the eligibility determination process. This person will also monitor the detailed hearing officer pending cases report.

The Tennessee Department of Human Resources title for this position is Attorney 4.

Skills

Applicants should have a current, valid license to practice law in Tennessee and at least 5 years of relevant experience.

Experience with administrative proceedings is strongly desired, as is ! supervisory experience. Familiarity with Medicaid or other government benefit programs will be helpful. This person must have significant reserves of patience and a willingness to take on a daunting level of responsibility to help create, train on and oversee a process that is still being defined. This position is all about process and due process. The person filling this position must understand the importance of predictable rules and policies and ensuring that TennCare applicants are dealt with fairly and that their appeals are handled within the appropriate timeframes.
