About the Position:
You will serve as an Attorney - Advisor (General) for the Nashville District, United States Army Corps of Engineers.

Established in 1888, the Nashville District employs approximately 750 people that are spread over 59,000 square miles in seven states. Our civilian workforce is made up of professional engineers, architects, planners, economists, biologist and other specialists who support a very diverse civil works mission that includes navigation, flood damage reduction, hydropower and recreation. The Office of Counsel is comprised of 7 attorneys and 1 administrative support team member.

This position is located in Nashville TN, nicknamed "Athens of the South" because of The Parthenon, the only full scale replica of the Greek temple in the world and "Music City USA" in honor of the cityÂ's role ! in the history and formation of country music. The city has na! tural beauty, Southern hospitality, serene weather, and something for everyone. It has music and arts, sports and recreation (NFL's Tennessee Titans, college football, NHL's Nashville Predators, minor league baseball), history and heritage.

NOTICE OF VETERANS' PREFERENCE

There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Defense considers veterans' preference eligibility a positive factor for attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g. DD Form 214, "Certificate for Release or Discharge from Active Duty") to their submissions.

Must be a U.S. Citizen DUTIES:
  • Serves as an Attorney-Adviser (General) in the Office of Counsel, Nashville District, Corps of Engineers. As an Attorney-Adviser, provides oral and written advice concerning civilian personnel law, employment discrimination law, and all labor relations matters. Reviews proposed activity regulations for legal sufficiency and impact on other regulations, and on programs, procedures, and methods of operation. Practices preventive law by informing manageme! nt of the impact of changes in civilian personnel and labor law and reg! ulations; advising managers and supervisors on informal resolution of grievances and providing advice to line management and EEO Officer on resolving informal discrimination complaints; and advising or participating on the management negotiating teams before and during union contract negotiations.
  • Represents the District as a trial attorney before arbitrators, investigators, and administrative judges from various agencies including the Merit Systems Protection Board, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, and the Federal Services Impasses Panel. Cases involve union/employee grievances on a wide variety of topics, adverse actions, reductions in force, employment discrimination, collective bargaining, negotiability determinations, and unfair labor practice charges.
  • Renders legal advice with respect to the Nashville DistrictÂ's Regulatory program. This involves resolving factually complex legal issues relating to r! egulations, practices, or other matters falling within the Corps of EngineersÂ' responsibility for the issuance and control of permits within the geographical area of the DistrictÂ's civil works boundaries. Reviews permit actions for legal sufficiency under Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Federal Water Pollution Control Act of 1972.
  • With regard to regulatory litigation, makes recommendations and referrals to the United States AttorneysÂ' Office for criminal or civil action, as appropriate. Consults with representatives of other interested Federal and State agencies, the U.S. AttorneysÂ' Office, private parties and their legal representatives. Evaluates results of investigations, determines whether additional evidence is required and whether civil or criminal actions should be initiated, seek legal precedent on complex legal and factual issues. Assists Assistant U.S. Attorneys in the prosecution of violations. Prepares litigation! reports justifying the DistrictÂ's position.
  • Performs other g! eneral law duties as assigned, which may include fiscal, ethics, torts, FOIA, and other practice areas.
QUALIFICATIONS REQUIRED:
In order to qualify for this position, you must have in excess of (2) years of professional legal experience acquired after being admitted to the bar, commensurate with the duties and responsibilities of this position. Examples of this experience are:

1. Identifying, researching, evaluating and analyzing complex facts and legal issues, using statutes, regulations, and case law,

2. Formulating alternative courses of action to meet the needs of clients,

3. Explaining legal principles and the risks concerning alternative courses of action to decision makers,

4. Advising management and EEO concerning civilian personnel law, employment discrimination law, and all labor relations matters,

5. Advising staff and management concerning regulatory matters,

6. Representing clients bef! ore administrative and judicial tribunals,

7. Communicating effectively orally and in writing.

NOTE: Experience MUST be documented in your resume.

Education:
In order to qualify for this position, you must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA), and have the first professional law degree (L.L.B. or J.D.).

Bar Membership: An applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
